1. Agreement to terms
By accessing or using Lynxe ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you are under 18, you represent that you have your parent or guardian's permission to use the Service. If you do not agree to these Terms, do not use Lynxe.
Lynxe is operated by [Legal Entity Pty Ltd] (ABN/ACN: [number]), trading as Lynxe ("we", "our", "us"), based in New South Wales, Australia.
2. Description of service
Lynxe is an AI-powered study tool that allows users to:
- Record lectures and classes
- Automatically transcribe audio recordings
- Generate structured study notes from recordings, uploaded files, links, and pasted text
- Create quiz questions, flashcards, and exam preparation materials
- Search across lecture content using AI-powered semantic search
- Track upcoming assessments and generate targeted study materials
The Service is designed for educational purposes and is intended to supplement, not replace, active participation in classes and independent study.
3. Accounts
To use Lynxe, you must create an account by providing a valid email address and other required information. You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activity that occurs under your account
- Notifying us immediately at support@lynxe.io if you suspect unauthorised access to your account
We reserve the right to suspend or terminate accounts that violate these Terms.
4. Acceptable use
You agree to use Lynxe only for lawful, educational purposes. You agree not to:
- Use Lynxe to record any person without their knowledge where required by law. New South Wales permits one-party consent recording under the Surveillance Devices Act 2007 (meaning you may record a conversation you are a participant in); laws vary by state and territory — you are responsible for understanding and complying with recording laws in your jurisdiction
- Submit content that is illegal, defamatory, threatening, harassing, or violates any person's rights
- Use the Service to facilitate academic dishonesty, including submitting AI-generated notes or content as your own original work in assessments where this is prohibited by your school or institution
- Attempt to access other users' data, reverse-engineer the Service, or interfere with its operation
- Use automated tools, bots, or scripts to access the Service without our written permission
- Resell, redistribute, or commercially exploit the Service or its outputs without our written permission
- Upload content that contains malware, viruses, or harmful code
- Circumvent any access controls, rate limits, or usage restrictions
5. Content and intellectual property
Your content
You retain ownership of all content you create, upload, or record through Lynxe, including audio recordings, uploaded files, and any text you input ("Your Content"). By using the Service, you grant us a limited, non-exclusive licence to process, store, and transmit Your Content solely to provide and improve the Service for you.
We do not claim ownership of Your Content. We do not use Your Content to train AI models. Your recordings, notes, and uploads remain yours.
AI-generated content
Notes, quiz questions, flashcards, and other materials generated by Lynxe's AI features ("Generated Content") are produced for your personal educational use. You may use, copy, and share Generated Content freely for non-commercial educational purposes.
Generated Content is produced by AI and may contain errors, inaccuracies, or omissions. You should always verify Generated Content against your course materials, textbooks, and teacher guidance. Lynxe does not guarantee the accuracy, completeness, or suitability of Generated Content for any specific assessment or examination.
Our intellectual property
The Lynxe name, logo, design, software, and documentation are our intellectual property and are protected by copyright and other laws. You may not copy, modify, distribute, or create derivative works from our intellectual property without our written permission.
6. Subscriptions and payments
Free tier
Lynxe offers a free tier with limited usage. The specific limits of the free tier may change from time to time, and we will communicate any material changes in advance.
Paid subscriptions
Paid subscriptions provide access to additional features and higher usage limits. Subscription terms, pricing, and included features are displayed at the time of purchase.
- Subscriptions are billed monthly or annually, as selected at checkout.
- Payment is processed by Stripe. By subscribing, you also agree to Stripe's terms of service.
- Subscriptions automatically renew at the end of each billing period unless cancelled.
- You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period — no partial refunds are provided for unused time within a billing period.
- We reserve the right to change subscription pricing with 30 days' notice. Price changes do not apply to the current billing period.
Refunds
Refund requests are considered on a case-by-case basis. Contact support@lynxe.io within 14 days of a charge to request a refund. We are not obligated to provide refunds but will act reasonably and in accordance with Australian Consumer Law.
7. Usage limits and fair use
Paid subscriptions include a generous monthly allocation of lecture-hours and AI features. If you exceed your allocation:
- We may reduce the quality of AI-generated content (for example, by using a faster but less capable AI model) for the remainder of the billing period.
- We will not charge overage fees without your explicit consent.
- We will never permanently delete your existing content due to exceeding usage limits.
We reserve the right to limit or throttle usage that we reasonably determine to be abusive, automated, or inconsistent with normal individual educational use.
8. Availability and support
We aim to provide a reliable service but do not guarantee 100% uptime. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.
We provide support via email at support@lynxe.io. We aim to respond to support requests within 48 hours on business days.
9. Privacy
Your privacy is important to us. Please review our Privacy Policy for detailed information about how we collect, use, and protect your personal information.
10. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
Specifically:
- AI-generated content is not guaranteed to be accurate. Lynxe uses AI to generate notes, questions, and study materials. AI can make mistakes. You are responsible for verifying all content against authoritative sources.
- Lynxe is not a substitute for studying. The Service is a study aid, not a replacement for attending classes, reading textbooks, or completing coursework.
- Lynxe does not guarantee academic outcomes. We do not promise any specific grades, marks, or results from using the Service.
- Recording laws are your responsibility. While NSW generally permits one-party consent recording, laws differ across Australian states and territories and in other countries. You are solely responsible for complying with applicable laws when using the recording feature.
11. Limitation of liability
To the maximum extent permitted by Australian law, including the Australian Consumer Law:
- Our total liability for any claim arising from or related to the Service is limited to the amount you paid us in the 12 months preceding the claim, or AUD $100, whichever is greater.
- We are not liable for any indirect, incidental, consequential, or punitive damages, including loss of data, loss of academic opportunity, or loss of profit.
- Nothing in these Terms excludes or limits any rights you have under the Australian Consumer Law that cannot be excluded or limited by contract.
12. Indemnification
You agree to indemnify and hold us harmless from any claims, damages, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any law or third-party rights.
13. Termination
We may suspend or terminate your access to the Service at any time if:
- You violate these Terms
- Your use poses a security risk to the Service or other users
- We are required to do so by law
- We discontinue the Service (with reasonable notice)
Upon termination, your right to use the Service ceases immediately. We will make your data available for export for 30 days following termination, after which it may be permanently deleted.
You may terminate your account at any time by contacting support@lynxe.io or through the account settings in the application.
14. Changes to these terms
We may update these Terms from time to time. If we make material changes, we will notify you via email or through a notice in the application at least 14 days before the changes take effect. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
15. Governing law
These Terms are governed by the laws of New South Wales, Australia. Any disputes arising from or related to these Terms or the Service will be resolved in the courts of New South Wales, Australia.
16. General
- If any provision of these Terms is found to be unenforceable, the remaining provisions remain in full effect.
- Our failure to enforce any provision of these Terms does not constitute a waiver of that provision.
- These Terms constitute the entire agreement between you and Lynxe regarding your use of the Service.
